СПЕЦІАЛЬНА КОНФІСКАЦІЯ У КРИМІНАЛЬНОМУ ПРАВІ

Abstract

Розкрито стан дослідження спеціальної конфіскації; висвітлено її соціальну обумовленість; визначено правову природу та місце спеціальної конфіскації в системі кримінально-правових норм, а також мету, підстави та умови застосування. Наведено авторське визначення поняття «спеціальна конфіскація», обґрунтовано необхідність виключення конфіскації майна зі системи покарань України та запропоновано низку змін і доповнень до чинного кримінального законодавства. Для науковців, науково-педагогічних працівників, здобувачів освіти юридичних факультетів та закладів освіти юридичного спрямування, а також практичних працівників практичних органів Національної поліції. The monograph is devoted to the criminal law characteristic of special confiscation in criminal law. The scientific paper reflects the current development in the research of special confiscation; its social determination, the legal nature and place in the system of criminal law provisions, as well as the purpose, basis and conditions for the application is highlighted The author’s definition of the special confiscation is substantiated, the necessity of exclusion seizure of property from the system of punishments of Ukraine is substantiated. On the basis of the obtained results of the provided research, specific proposals for solving the most problematic issues of special confiscation have been formulated. For scientists, teachers, students and cadets of law faculties and legal education institutions, as well as law enforcement officials.
